These general terms and conditions of sale, hereinafter referred to as the "General Terms and Conditions", govern the terms and conditions of distance selling between any user of the www.23maiparis.com website wishing to make a purchase on the www.23maiparis.com website (hereinafter referred to as the "Internet user") and the company ELG PARIS, whose head office is located at 21 rue spontini, 75116 Paris, FRANCE (hereinafter referred to as "ELG PARIS"). SUBJECT
ELG PARIS' MAIN ACTIVITY IS THE DISTANCE SELLING OF CHILDREN'S GOODS ON THE WWW.23MAIPARIS.COM WEBSITE. THESE TERMS AND CONDITIONS APPLY EXCLUSIVELY AND SUPERSEDE ALL OTHER TERMS AND CONDITIONS, UNLESS EXPRESSLY AGREED OTHERWISE IN ADVANCE IN WRITING. ELG PARIS MAY MODIFY SOME OF THESE TERMS AND CONDITIONS AT ANY TIME. THESE MODIFICATIONS TAKE EFFECT AS SOON AS THEY ARE PUT ONLINE AND WILL BE APPLIED TO ORDERS PLACED AFTER THIS DATE. ELG PARIS CONSIDERS THAT BY VALIDATING HIS/HER ORDER, THE INTERNET USER HAS DULY READ THE CONDITIONS AND ACCEPTS THEM UNRESERVEDLY.
PRODUCTS AND COMPLIANCE
The Products offered for sale are presented on the website www.23maiparis.com using descriptive sheets and photos with the greatest possible accuracy, but in some cases cannot ensure perfect similarity with the product offered for sale, particularly in terms of colors, which may appear differently depending on the quality of the photography or the adaptation of colors on the screen. Consequently, these differences cannot be interpreted as defects of conformity, lead to the nullity of the sale or incur the responsibility of ELG PARIS.
The essential characteristics of the goods, services and their respective prices are made available to the Internet user on www.23maiparis.com. The Internet user certifies that he/she has received details of delivery costs as well as the terms of payment, delivery and execution of the contract. ELG PARIS undertakes to honour the internet user's order within the limits of available product stocks only. In the event of non-availability, ELG PARIS undertakes to inform the Customer.
Some of our boxes contain accessories to complete the outfit. However, if we are out of stock on one of the accessories (price under 15€), we will replace it with another accessory at an equivalent price.
PERSONALIZATION
On the www.23maiparis.com website, ELG PARIS offers customers the possibility of personalizing their products with hand embroidery.
It is the customer's responsibility to fill in the chosen text accurately and to check the certainty of the elements to be embroidered when ordering.
ELG PARIS will embroider the text on the products exactly as it appears on the order form.
Customized items will not be returned or refunded.
Any order errors that are the fault of the customer will not be returned or exchanged.
If, at the time of ordering, the customer has forgotten to specify a customization, or the customization of the order is too long, it is up to the customer to come back to us to indicate any changes.
PRICE
All prices shown on the site include all taxes. Product prices are indicated in euros. ELG PARIS reserves the right to modify its prices without notice and the prices applied to the Internet user correspond to those displayed on the site at the time of the order. Customs duties or other local taxes or import duties or state taxes may be payable in certain cases.
These rights and sums are not the responsibility of ELG PARIS. They are the responsibility of the Internet user (declarations, payment to the competent authorities, etc.). In this respect, ELG PARIS invites the Internet user to obtain information on these aspects from the corresponding local authorities.
The goods remain the full property of ELG PARIS until receipt of the total amount due and paid by the Internet user.
The prices indicated include the costs of processing the order. The shipping and delivery costs applied are those indicated on the site at the time of the order.
PAYMENT
Internet users pay on the www.23maiparis.com website by credit card (CB, Visa or Mastercard) via the Stripe secure payment platform or by Paypal.
ELG PARIS entrusts the security of its transactions to the service provider Stripe. Payment is secured by our partner Stripe's online payment system. Bank details circulate on the Internet only in encrypted form, i.e. they are encoded in such a way as to make them completely illegible and are therefore never stored by ELG PARIS.
The Internet user confirms that he is the legal holder of the card to be debited and that he is legally entitled to use it.
In the event of an error, or if it is impossible to debit the card, the sale is immediately cancelled and the order cancelled.
TERMS OF DELIVERY
ELG PARIS delivers its products in France and Europe. The order preparation time is 48 hours and the delivery time is approximately 5 working days (unless otherwise indicated on the site). The risks of mail theft are borne by the purchaser from the moment the products leave the ELG PARIS premises.
The delivery times indicated on the site are indicative times, corresponding to average processing and delivery times. In order for these times to be respected, the Internet user must ensure that he/she has provided accurate and complete information concerning the delivery address. ELG PARIS cannot be held responsible for the consequences of a delay in delivery for which it is not responsible.
If the delivery time is abnormally long (maximum 10 days following dispatch of the parcel), the Internet user must inform ELG PARIS customer service as soon as possible at [email protected] so that an inquiry can be opened with the carrier and action taken in the event of loss of the parcel. We must follow the procedure of our carrier GLS in order to refund you or return your order. The maximum duration of the procedure is 45 days.
All Internet users are required to check the condition of the packaging and the contents of the goods when their order is delivered. In the event of a complaint concerning any defects or signs of deterioration in the products (missing product, damaged parcel, broken products, etc.), the Internet user must mention his/her observations on the delivery slip at the time of delivery, and confirm them first by e-mail with supporting photos to the customer service department at the following e-mail address: [email protected].
RETURNS AND REFUNDS
In the event that the items ordered do not give complete satisfaction to the Internet user, in accordance with article L. 121-20 of the French Consumer Code, "the consumer has a period of fourteen clear days in which to exercise his right of withdrawal without having to justify his reasons or pay any penalties, with the exception, where applicable, of the cost of returning the goods". "The period referred to in the previous paragraph runs from receipt for goods or acceptance of the offer for services".
We inform Internet users that in accordance with article L. 121-20-2 of the French Consumer Code, this right of withdrawal cannot be exercised for any personalized item.
To proceed with the return, the Internet user must first contact ELG PARIS at [email protected] specifying the reason for the return and his/her order number.
The Internet user must keep the proof of deposit of the parcel which will be given to him by the Post Office until the order is reimbursed. If the parcel is lost, no refund will be made.
PERSONAL DATA PROTECTION
In accordance with the French Data Protection Act of January 6, 1978, you have the right to question, access, modify, oppose and rectify any personal data concerning you.
All information contained in the Internet user's account is used solely within the framework of the commercial relationship with ELG PARIS.
This information is never shared with third parties or resold. Finally, the Internet user's banking information is never in the possession of ELG PARIS.
INTELLECTUAL PROPERTY

All trademarks, texts, comments, works, illustrations and images, whether visual or audio, including the underlying technology on the www.23maiparis.com website, are protected by copyright, trademarks, patents and image rights. They are the full and complete property of ELG PARIS or its partners. Any reproduction or representation, in whole or in part, constitutes an infringement which may incur the civil and criminal liability of its author.
SETTLEMENT OF DISPUTES
These terms and conditions are governed by French law. Any dispute shall be subject to a prior attempt at amicable settlement.
In the absence of amicable settlement, the French courts shall have jurisdiction, notwithstanding multiple defendants or the introduction of third parties.
